Apply For A Corporation EIN Online

You must be able to identify the corporation's structure to apply for an EIN online.  If you are unsure if you should apply for an EIN online as a corporation, S corporation, or personal service corporation, read the following descriptions below to get a better idea.

Apply as a Corporation for an EIN online if:

  • You or a group of individuals filed articles of incorporation with the state's secretary of state to establish the legal entity as a corporation, thereby granting it certain legal rights, privileges and powers; and
  • You (aka a shareholder) and the other owners (if applicable) are considered separate from the corporation, which has an indefinite lifespan, and is responsible for its own debts and obligations.

Apply as a S Corporation for an EIN online if:

  • You or a group of individuals filed articles of incorporation with the state's secretary of state to establish the legal entity as a corporation, thereby granting it certain legal rights, privileges, liabilities and powers;
  • You or a group of individuals filed Form 2553 (Election by a Small Business Corporation) with the IRS to elect S corporation status for your corporation, thereby avoiding double taxation (tax on corporate profits & on shareholders' dividends); and
  • Your corporation is exempt from federal income tax other than tax on certain capital gains and passive income. The profits or losses are divided amongst the shareholders, and the shareholders must report it on their individual tax return - called single taxation.

NOTE: If you want to elect S-corporation status, you must file Form 2553, "Election by a Small Business Corporation".

Apply as a Personal Service Corporation for an EIN online if:

  • You or a group of individuals filed articles of incorporation with the state's secretary of state to establish the legal entity as a personal service corporation, thereby granting it certain legal rights, privileges, liabilities, and powers;
  • Your corporation offers professional services in the field of accounting, actuarial science, architecture, consulting, engineering, health, law, or performing arts;
  • You or the other shareholders own all or most of the stock of the corporation and are employees of the corporation who perform the professional services; and
  • Your corporation sells its ideas or expertise and does not sell goods or products.
